Please read these Terms and Conditions (“Terms”) carefully before using Delphy Pool (“the Site”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please refrain from using the Site.

Membership: 

  1. Membership to Delphy Pool is required to access diving and swimming facilities. Membership is subject to approval. 
  2. Members must provide valid certification for scuba diving or freediving, as applicable, to become and remain a member.
  3. Membership fees are non-refundable and are subject to change. Any changes in fees will be communicated in advance.

Booking and Payment: 

  1. Diving and swimming sessions must be booked in advance through the Site or other approved booking channels. 
  2. Payment for sessions must be made at the time of booking.
  3. Instructors and dive schools must provide accurate student numbers when booking. Payment for non-member students is required in advance.

Safety: 

  1. All members, divers, and swimmers must adhere to safety guidelines and instructions provided by Delphy Pool. 
  2. Divers must comply with buddy system protocols, and freedivers must inform others of their intentions before diving. 
  3. Delphy Pool reserves the right to restrict access to certain areas or activities if safety conditions are not met.

Equipment and Liability: 

  1. Divers and swimmers are responsible for providing their own equipment, ensuring its safety and suitability for use. 
  2. Delphy Pool is not liable for any loss, damage, or injury resulting from the use of personal equipment or facilities.

Conduct: 

  1. Members, divers, and swimmers are expected to behave in a respectful and responsible manner towards others and the environment. 
  2. Any actions that may endanger oneself, others, or the facility will not be tolerated. 
  3. Delphy Pool reserves the right to refuse access or revoke membership for individuals who do not comply with the code of conduct.

Water Safety and Fitness:

a. Divers and swimmers must have a good understanding of water safety practices and adhere to them at all times. 

b. It is the responsibility of each individual to assess their own fitness level and ensure they are in good health before engaging in diving or swimming activities. 

c. Individuals with medical conditions or concerns that may affect their ability to dive or swim safely should consult with a qualified healthcare professional before participating. 

d. Delphy Pool reserves the right to request a medical clearance certificate from any member, diver, or swimmer if deemed necessary. 

e. It is recommended that divers and swimmers maintain a level of physical fitness appropriate for their chosen activities to ensure their safety and enjoyment. 

f. Delphy Pool encourages participants to stay hydrated, avoid alcohol consumption, and comply with any additional safety guidelines or instructions provided by the facility or its staff.

Personal Responsibility:

a. All members, divers, and swimmers are responsible for their own actions and safety while in the water and around the Delphy Pool premises.

b. Participants should exercise caution, be aware of their surroundings, and avoid behaviors that may endanger themselves or others.

c. It is the individual’s responsibility to follow all safety guidelines, instructions, and regulations provided by Delphy Pool staff.

d. Delphy Pool shall not be held liable for any loss, injury, or damage resulting from the negligence or misconduct of participants.

e. Participants are responsible for securing their personal belongings. Delphy Pool is not liable for any loss, theft, or damage to personal property.

Cancellations and Refunds: 

  1. Cancellations must be made within the specified time frame provided at the time of booking to be eligible for a refund. 
  2. Refunds for cancellations are subject to Delphy Pool’s discretion and any applicable fees.

Intellectual Property: 

  1. The content and materials on the Site are protected by intellectual property rights and are owned or licensed by Delphy Pool. 
  2. Users are prohibited from reproducing, distributing, modifying, or using any content from the Site without prior written consent.

Amendments and Modifications: 

  1. Delphy Pool reserves the right to amend or modify these Terms at any time without prior notice.
  2. Users are encouraged to review the Terms periodically to stay informed of any changes.

Customer-Owned Diving Equipment:
Please be aware that any diving equipment owned by customers and brought to Delphy Pool is not covered under our liability or insurance. It is the sole responsibility of the customer to ensure that their equipment is in good working condition, properly maintained, and suitable for use.

Delphy Pool does not assume any liability for any loss, damage, or injury arising from the use of customer-owned diving equipment. We strongly recommend that customers regularly inspect and service their equipment as per manufacturer guidelines to ensure its safety and reliability.

While our facilities provide a secure environment for diving activities, customers are responsible for the proper handling, maintenance, and operation of their personal diving equipment. It is essential to follow all safety procedures and manufacturer recommendations when using customer-owned equipment.

By using customer-owned diving equipment at Delphy Pool, customers acknowledge and accept full responsibility for their equipment’s performance, safety, and suitability for use during their diving activities.
Training and Safety Measures:
At Delphy Pool, we prioritize the safety of our members and visitors. We strongly emphasize the importance of proper training and adherence to safety guidelines, particularly regarding the risk of loss of motor control or blackout during diving activities. To ensure a safe environment for all participants, the following term is implemented:

Loss of Motor Control or Blackout Policy:

a. Members and visitors are required to undergo proper training and certification in freediving or scuba diving before engaging in activities at Delphy Pool.

b. Any occurrence of loss of motor control or blackout during diving activities may result in the immediate revocation of membership or access privileges.

c. We strongly recommend members and visitors receive training specifically addressing safety procedures, breath-holding techniques, and the prevention and recognition of blackout symptoms.

d. By participating in activities at Delphy Pool, members and visitors acknowledge their responsibility to prioritize safety, maintain proper training, and follow recognized safety protocols to minimize the risk of loss of motor control or blackout.

We prioritize the well-being of our diving community and are committed to maintaining a safe and secure environment. We ask all members and visitors to be aware of the risks associated with loss of motor control or blackout and to take the necessary precautions to prevent such incidents.

Booking with a Competent Buddy:

At Delphy Pool, we prioritize the safety of our members and emphasize the importance of diving with a competent buddy. To ensure a secure diving environment, the following term is implemented:

Booking with a Competent Buddy:

a. All divers are required to book their diving sessions with a competent buddy.

b. A competent buddy is defined as an individual who possesses the necessary training, experience, and certification to provide appropriate assistance and support during the dive.

c. It is the responsibility of each diver to ensure they have a competent buddy for their diving session.

d. Delphy Pool reserves the right to deny access to divers who fail to comply with the buddy system or attempt to dive without a competent buddy.

e. By booking a diving session at Delphy Pool, divers acknowledge and accept their responsibility to dive with a competent buddy, adhering to the buddy system at all times.

Diving with a competent buddy enhances safety, allows for mutual assistance, and provides an added layer of security during underwater activities. We encourage all divers to prioritize the buddy system and make responsible choices when booking their diving sessions.
